About this service
If FBR passes an order you believe is wrong — an amended assessment, a penalty or a refusal of a refund — the law gives you a right of appeal. Depending on the law in force and the amount involved, the first appeal lies to the Commissioner Inland Revenue (Appeals) or the Appellate Tribunal Inland Revenue, and questions of law can go further to the High Court.
Appeals have strict time limits that run from the date the order is served, so the first step is always to read the order and check the date.
- Review of the order and an honest view of the strength of your case
- Advice on the correct forum, the time limit and any payment required with the appeal
- Grounds of appeal and supporting documents prepared
- Application for stay of the tax demand, where appropriate
- Representation at hearings by suitably qualified and authorised professionals
Documents required
- The order you want to appeal, with proof of the date you received it
- The notices that led to the order and your replies
- The related return, wealth statement and financial statements
- Documents and evidence supporting your position
- Tax demand notice and any payment already made
- Earlier appellate orders in the same matter, if any
Exact requirements depend on your case. Your officer will confirm the final list after reviewing your details.
How it works
- Send the inquiry form on this page with your contact details.
- We review the order and the dates, and tell you whether an appeal is possible and what it involves.
- The scope, the professionals who will act for you and the fee are agreed with you in writing.
- The grounds of appeal are prepared and shared with you; the appeal is filed only after your approval.
- You are kept informed of hearing dates and outcomes.
Frequently asked questions
How much time do I have to file an appeal?
The law sets a fixed number of days from the date the order is served, and it differs by forum. Send us the order immediately so that the limit is not missed.
Do I have to pay the tax demanded before appealing?
Rules on payment and on stay of demand depend on the forum and current law. We explain what applies and whether a stay application makes sense.
Can you promise that the appeal will succeed?
No one honestly can. We give you a frank assessment of your case before you spend money on it.
